Bad Credit Agency

Can a credit agency take you to court to collect money that you owe a credit card company?

Well my credit limit was 300 bucks, I am being threatned to pay 800 and something in just fees alone. To bring my "balance" to the monthly payments of 10-30 bucks a month. Which would be an extra 300 bucks. Can they seriously take me to court to collect the 800 bucks?

  1. Yes they will. They wont just forget about it. You owe them money. Call them up and start making payments.
  2. Happens all the time. Typically the credit card company writes off the debt and sells it to collection agencies. The collection agency then owns the debt and can sue you. In some cases the credit card company doesn't actually sell the debt but assigns it to the collection agency. Some of the larger credit card companies have their own collection agencies Collection agencies seem to be taking folks to court for smaller amounts these days too.

  4. yea they can but then again I owe alot of money too and they know i barely have a job and yes i can prove it. what pisses me off is when they call you, and TELL you that you WILL go out borrow the money and pay them off. they dont realize that some people in this world dont have a rich uncle and they cant pay off their debt. I know it was stupid to rack up a big bill but that was never my intention. I know now not to get into big messes with credit cards. you dont open a new account to close another, its just double trouble.

  6. Yes they can but there are many circumstances where they can't. It all depends on a lot of factors. Many of them you do not mention, like when did it go into collections, what is your home state. This could be an old time barred debt that some junk collection agency is trying to collect. Without more info it's hard to give you a correct answer.   7. Reality check people! They generally do not sue people for $800 credit card debts. They are content to just have the collection agency trash your credit and harass you. If you can handle that then ignore them.
  8. Hell no!!!!!!! Please don't listen to all these straight and arrow folks who probably pay all they bills before they even due. No one will take you to court for $800. It costs money to go to court and they are not gonna waste that on a measly $800. All they will continue to do is call, threaten and harrass you. You should tell them "you don't have the money today, you didn't have it yesterday and you probably won't have it tomorrow. So do as you wish as far as everything is concerned" If in some rare case they do take you to court, which I know they wont all the judge will do is find the judgement for them and you will owe them the money plus court costs. But that doesn't really mean anything because I would just let them know " I didn't have the money to pay you before so what makes you think I have it now." All credit agencys do is call and try to collect. You can't go to jail for not paying your bills or credit cards. However your credit score will go down because it does affect your credit. But if you are not trying to buy a house in the next 5 years who cares. You will have time to fix all that when you get on your feet. Don't let all these lames scare you into paying your bills. They are doing exactly what the collection companies are doing. So don't worry I know people who owe way more than that and nothing has happened to them. Good luck!
