Can my ex-girlfriend sue me for a streetbike she bought with her credit.?

She bought the motorcycle with me there at the dealership. I could not afford the bike at the time.So she used her credit and bought the bike and made the payments on it.We broke up. She wanted me to make a payment on the bike or she was going to take it.I offered to her, I would take over the payments on the existing loan she had, and that we would right up a promissary note together.I gave her some money a month of July's payment just so she wouldnt take the bike.Thinking that we would get a legal contract going and i could purchase the bike .The next month she came over with all the billing information for the promissary note.the next day she decided no on the exsisting loan and promissary note, either I pay for the bike in full or get a loan ,or she is takeing the bike back,I could not get a loan or the money, bad credit.I stoped payments to her which was only one.About a month later I returned the bike to her posseinon as she demanded it .Now she is trying to sue The bike is in her name,

  2. In short - YES she can sue you and YES she can win in small claims court. By accepting payment from you, YOU ALREADY HAVE a legal contract. You don't necessarily have to have a written document for a contract - a series of documents or conduct such as payments can be construed as a legal and binding contract. Because you returned the bike, she won't be able to collect much in damages, but she MIGHT be able to get some out of you for late payment fees, etc. She may also be able to get the payments you owe from the time it was purchased until you gave her possession of the bike. After that, it's more than likely her problem - UNLESS you piss the judge off. Then you are screwed.

Her credit card, she made payments, you didn't make payments as originally promised, she told you to pay or get your own loan to pay back and you didn't- you were basically trying to STEAL from her and she wised up. That about sum up the situation? You should shut up and pay all expenses she incurred, used bike is now maybe worth 1/2 of purchase price so cover that and let her have bike. You still owe difference and if sued the court should order you to pay or forfeit drivers license as a fraud penalty on purchase of vehicle. If ex girlfriend is in my area- Madison, Wi- have her stop by and I will teach her the staff drill to break your knees to start.
  5. by the way the laws are even if the bike was for you she purchased it with her credit so it makes it hers.if you drew up the papers for it then maybe you have a leg to stand on.
