My sister stole my identity, how do I remove this bad credit without prosecuting?
After paying off all my credit cards, auto loan and mortgages, I let my credit sit without activity for the past seven years. I tried to finance a car the other day and found out that there is nothing on my credit report except a deliquent, closed to non payment Visa from Bank of America and a a delinquent closed account due to non payment from Lane Bryant. AFter investigating (I never had these 2 cards), I found out it was my sister. How do I get these bad reports off my credit report without prosecuting my sister? I want her punished, but not go to jail! And I know she doesn't have the 5K to repay the cards.

- You only have two choices. Not punish your sister and punish yourself by accepting this debt as your own and paying it. While the account would now show full paid, the deliquency would stay on the account for years. Alternately you file a police report and allow her to be prosecuted...then you file the police report with the lenders to have the delinquent account removed from your credit history.
- If your sister is willing to do that to you, then I don't see why you shouldn't prosecute. Either you punish yourself, or you punish your sister. How do you know this will not happen again in the future?
- I was online the other day disputing items on my credit report and TransUnion actually had a tab that stated "Does not belong to me, belongs to relative or person named similar". Maybe try that for the one agency. I would dispute it through your credit bureaus anyways. How do you know it was your sister? Perhaps it was a stranger? This is the world's biggest crime because it is actually quite hard to find the people that do this type of crime. I would dispute it on your credit report.
- My Wife went through this a couple of years ago with her Son and there is no way of doing this without filing a police report and the sending copies to the lenders. Some police departments will not go after people since it's a family thing and they don't think people will show up in court to testify. My Wife told the police she wanted them to go after her Son and they still refused.
- I agree with the other posters. This happened to a friend of mine, her mother stole her identity and totally had trashed her credit by the time she was 22. Ten years later she (my friend) is still paying things off because they said there was nothing they could do if she didn't prosecute her mom. If you don't want to prosecute your sister, you will need to pay off the debts, but if I were you I would make my sister pay me money every single month until they are paid off. I wouldn't care if she had the $5,000 - she can work 3 jobs if she has to so that she can right her wrong.
