I'm suing a credit reporting agency for three hundred thousand dollars?

One credit reporting agency refused to remove negative information from my credit report. This negative info is not some credit card, but a judgment and a federal tax lien! I have been denied credit and I am suing for defamation and for numerous violations of the FCRA. My questions is, has anyone heard of a successful lawsuit similar to my case? Thanks

  1. Without all of the details I don't think anyone here would be able to give you a decent answer. But a couple of general points(again not knowing all of the details). If they were valid items, that is you actually had these judgements and liens. Then there is not much of a case you have against the CRA in question, as they are just reporting valid information. If they are not yours or should not be on there anymore because they have been settled or should have been removed because of age then you would need what proof you took with them to get it off(I.E. letters to them). Then if you want to claim punitive damages you would need proof of any damages you incurred, such as a higher interest rate.

  3. Did you take the appropriate steps first such as disputing the judgment and federal tax lien? Or are you stating the federal tax lien has been satisfied as well as the judgment? If the answer to the second question is yes, the paid lien and judgment still stays on your credit report for 7 years from date paid, but with a $0 balance. If you are stating you never ever had this judgment nor federal tax lien, have disputed it, they should have given proof with their communication with said creditors that the debt did exist. Have I heard of such a case? No.
  4. For starters, yes. I have file and won my own FCRA suits against Equifax. I have also helped a few dozen other people do the same. Mostly against the creditor, but in a few cases against the CRA's. Now, as OC says, what are the details? Were these your items, or were they someone else's put on your report by mistake? This is very common. As for your lawsuit, you must follow the procedures in the Fair Credit Reporting Act EXACTLY!!! You must send them a dispute letter, and give them 30 days to respond. If they say the information is accurate you must demand to know how this was investigated. They will inform you of what their source was. The FCRA already mandates the amount you can sue them for ($1000 for each violation), plus any damages this caused you. For example, if you were denied credit due to their credit report, and this caused you a financial loss, you can sue for those damages. What damages do you have to justify $300k? In very rare cases the courts will hit a CRA or collection agency with a huge fine. Recently Arrow Collection was hit with over $200k in penalties, but that was due to repeated and deliberate violations of the FCRA and FDCA laws. If those reports are not yours, you will have an easy time winning your case....but don't hold your breath collection a huge settlement.
